JUST IN; PDP ask court to jail Commissioner of Police over alleged contempt

Over the alleged refusal of the Commissioner of Police in Ebonyi state, Aliyu Garaba, to obey a court order, the Peoples Democratic Party (PDP) Ebonyi state chapter has appeared before a Federal High Court in Abuja and asked that it sends the Commissioner to jail.

CRIMECHANNELS learnt that the committal proceeding against Aliyu Garba was filed by the caretaker committee Chairman of the PDP in Ebonyi State, Hon. Fred Udeogu.

It was gathered that the court in its previous ruling, ordered the Commissioner not to recognize Barrister Chief Onyekachi Nwebonyi, Engineer Francis Ori and Emeka Ogbo, as officers of the PDP pending the determination of the suit.

But the PDP has now returned to the court, through its counsel, Barr. Okoro Nkemakolam S.C, alleging that the CP didn’t obey the order of the court.


In a motion, the PDP is seeking an order “of this Honourable Court, committing Aliyu Garba, the Commissioner of Police Ebonyi State, to prison and detain in custody until he obeys the order this Honourable Court made on the 21st of January 2021.”

It said, “This honourable court in a well-considered ruling delivered on the 21st of January 2021, directed the Inspector General of Police, its servants, agents and/or officers from in whatsoever manner according recognition to the Barr Chief Onyekachi Nwebonyi, Engineer Francis Ori and Emeka Ogbo, as officers of the Peoples Democratic Party, pending the determination of the suit.”

“Despite the service of the order of court on the Inspector General of Police, and a written directive by the Inspector General of Police, to Aliyu Garba, the Commissioner of Police Ebonyi State, in utter disregard and disobedience to the order of this Honourable Court, has refused the Plaintiffs access to their party Secretariat.”

“The Applicant filed this motion on notice to commit Aliyu Garba the Commissioner of Police, Ebonyi State, to prison for contempt of court, for his refusal to obey the order of the Federal High Court Abuja, Division, directing him not to accord any form of recognition to Barr Chief Onyekachi Nwebonyi, Engineer Francis Ori and Emeka Ogbo, as officers of the Peoples Democratic Party, pending the determination of the substantive suit.”
